Terms of service and sale

DASHUND is published by a French business. This page is a translation provided for convenience: French law applies, and if the English and French versions differ, the French version prevails.

1. Purpose

These terms of service and sale (the “Terms”) govern access to and use of the DASHUND service, as well as the purchase of paid subscriptions. They apply to anyone who creates an account. By creating an account or purchasing a subscription, the customer accepts the Terms in force on that date.

2. Definitions

  • Service: the DASHUND online software, which makes it possible to publish Figma prototypes, share them through test links and analyze how they are used, along with its Figma plugin.
  • Customer: the business that creates an account and uses the Service for its professional activity; Account holder: the customer who purchases a subscription and pays for it.
  • Workspace: a space that groups prototypes and members; it always has an owner.
  • Member: a person with access to a workspace, with the role of owner, editor (manages prototypes) or viewer (view only).
  • Prototype: a Figma prototype published in the Service; Test link: an address that lets people use a prototype; Tester: a person who opens a test link, with no account.
  • Session: the use of a prototype by a tester, from the moment it is opened until the page is closed, or until five minutes pass with no click or screen change.
  • Data processing agreement: the personal data processing agreement, which is part of the Terms.

3. Publisher and access to the Service

The Service is published by Thomas Cescousse EI, a sole proprietorship registered in France, 60 avenue Jean Jaurès, 75019 Paris, France, SIREN 131 009 003 (“DASHUND”): see the legal notice.

The Service is reserved for businesses and professionals (designers, product teams, agencies) acting in the course of their business; it is not offered to consumers. By creating an account, the customer declares that they are acting in a professional capacity.

4. Account

The account is created after the email address is confirmed (sign-up with a password) or on a first login with Google or Microsoft. The customer provides accurate information, keeps their login credentials confidential and remains responsible for the use of their account. They report any unauthorized use to contact@dashund.link without delay.

5. Workspaces, members and roles

  • The owner of a workspace invites members and chooses their role. They are responsible for the people they invite and the rights they give them. An invitation is valid for 7 days.
  • The owner can offer ownership of a workspace to one of its members. The transfer only takes place if that member accepts it, within 7 days; the former owner then becomes an editor. No one can become the owner of a workspace, or liable for a subscription, without having accepted it.
  • After a transfer, the workspace counts toward the limits of the new owner’s plan. If the former owner has a 12-month commitment, the workspace remains covered by their subscription until the end of the commitment; the new owner is informed by email 30 days before. If the new owner’s plan does not cover the workspace, it is suspended until the new owner changes plans or complies with the limits of their plan; the workspace’s data is kept during the suspension.

6. Use of the Service

  • The customer warrants that they hold the necessary rights to the prototypes they publish and to their content.
  • The customer agrees not to ask testers to enter personal data in their prototypes, and to inform them that their use is measured, for example by referring to the privacy policy.
  • It is forbidden to use the Service to distribute unlawful content, to deceive people or collect their data without their knowledge, to infringe the rights of third parties, to disrupt the Service or to attempt to access other customers’ data.

7. Plans and limits

The Service is offered in four plans, which differ in the volumes allowed. Current limits: Free: 1 workspace, 1 editor, 100 sessions per month, 2 live prototypes, sessions kept for 30 days; Solo: 3 workspaces, 1 editor, 500 sessions per month, 5 live prototypes, sessions kept for 3 months; Pro: 3 workspaces, 5 editors, 2,000 sessions per month, 10 live prototypes, sessions kept for 6 months; Business: 10 workspaces, 30 editors, 10,000 sessions per month, unlimited live prototypes, sessions kept with no time limit. Editors (owners included) are counted once per person across all of the account holder’s workspaces, pending editor invitations included; the number of viewers is not limited.

The Solo plan is a single-user license: it is reserved for one person, the account holder, who may neither share their credentials nor let other people use their account. Working with several editors falls under the Pro and Business plans.

All features, including A/B tests, are available in every plan.

Beyond the monthly session limit, new sessions are recorded but hidden until a plan change or until the following month. When moving to a lower plan, sessions older than the new plan’s retention period are deleted during the next automatic cleanup (which the Service states before the change is confirmed); no prototype, member or link is deleted, but no prototype can be put live and no editor can be added as long as the limits are exceeded.

8. Prices, subscriptions and payment

Current prices: Free: free; Solo: $14 (€12) per month with no commitment, or $12 (€10) per month with a 12-month commitment; Pro: $29 (€25) per month with no commitment, or $24 (€21) per month with a 12-month commitment; Business: $79 (€69) per month with no commitment, or $65 (€57) per month with a 12-month commitment. The currency charged depends on the account holder’s country and is shown before payment. These prices are net: VAT is not applicable (article 293 B of the French General Tax Code), as DASHUND falls under the French small-business VAT exemption. Subscriptions are payable monthly in advance, by card or any other payment method offered by Stripe, DASHUND’s payment provider; an invoice is issued for each payment.

  • No commitment: the subscription renews automatically every month and can be canceled at any time; cancellation takes effect at the end of the paid period, with no refund for the current period.
  • With a 12-month commitment: the subscription is purchased for a fixed term of 12 months, at a reduced price, payable monthly. It cannot be canceled before the end of the term and all monthly payments for that period are due, except in the event of a serious breach by DASHUND that has not been remedied within 30 days of written notice. During the commitment, the account holder can move to a higher plan with a commitment (from Solo to Pro or Business, from Pro to Business), the difference being charged pro rata for the current month, with no change to the end date; moving to a lower plan is not possible. At the end of the 12 months, the subscription continues month to month at the same price and can be canceled at any time, like a subscription with no commitment.
  • DASHUND may change its prices: any change is announced at least 30 days in advance and applies from the following period; it does not apply to a commitment in progress before its end.

9. Late payment and non-payment

Any amount not paid by its due date automatically incurs, without any reminder, late payment penalties at the rate applied by the European Central Bank to its most recent refinancing operation, plus 10 percentage points, as well as a fixed collection fee of €40 (articles L441-10 and D441-5 of the French Commercial Code), without prejudice to additional compensation upon proof.

If a payment fails, the account holder is notified in the Service and asked to update their payment method; Stripe makes new payment attempts. If payment has still not gone through after these attempts, access to the workspaces covered by the subscription is suspended for all of their members, except for the account, billing, help and legal pages; the account holder is informed by email. During the suspension, test links keep recording sessions and no data is deleted because of the suspension; access is restored as soon as payment is settled. Without settlement within 30 days of the suspension, the subscription is automatically terminated and the account holder moves to the Free plan, with the consequences set out in article 7; amounts already due remain payable. If the subscription was purchased with a commitment, the monthly payments remaining until the end of the commitment become immediately due: they are invoiced, payable within 15 days.

10. Term, termination and account deletion

The Terms apply for as long as the account exists. The customer can delete their drafts and workspaces at any time, as well as their account from the My account page. A distinction should be made between:

  • The account: it can be deleted once the customer has transferred (to a member who accepts) or deleted the workspaces they share with other members. Their workspaces with no other member are then deleted along with their prototypes, links and sessions. Their account data is deleted, except for the data DASHUND must keep (see the privacy policy).
  • A subscription with no commitment: it ends when the account is deleted, with no refund for the current period.
  • A subscription with a commitment: deleting the account does not end the commitment. The monthly payments remain due until the end of the term, when the subscription ends. Until that date, the account is closed: login becomes impossible, the name and email address are erased, and only the data needed for billing and as proof of the contract is kept; the account is deleted at the end of the commitment. Workspaces transferred during the commitment remain covered by the subscription until the end of the term.

DASHUND may suspend or terminate an account in the event of a serious breach of the Terms (in particular unlawful use or an attack on the security of the Service), after informing the customer and, except in an emergency, after a formal notice that has gone unanswered for 15 days.

11. Intellectual property

  • The Service, its software, interfaces and texts, and the DASHUND brand and logo are the property of DASHUND. For the life of their account, the customer is granted a personal, non-exclusive and non-transferable right to use the Service for their business needs; no other right is granted.
  • Prototypes, their content, and the customer’s trademarks and logos remain the customer’s property. The customer authorizes DASHUND, solely for the duration and the needs of the Service, to host, reproduce and display this content (structure and images of the published screens) and to process it to produce the analyses. DASHUND acquires no rights to this content and does not use it for any other purpose.
  • DASHUND only names a customer as a reference with their prior consent.

12. Personal data

For the data of their account and their members, DASHUND acts as controller, under the privacy policy. For the data on how testers use their prototypes, the customer is the controller and DASHUND acts on their behalf as processor, under the data processing agreement (article 28 of the GDPR), which is part of the Terms. DASHUND does not reuse testers’ data for its own purposes: no profiling, no tracking between prototypes or customers, no resale.

13. Availability and third-party services

DASHUND uses reasonable means to ensure the availability and proper operation of the Service, as an obligation of means (best efforts), without guaranteeing uninterrupted operation; interruptions may be needed for maintenance and are, as far as possible, announced in advance. Displaying prototypes relies on Figma’s services, which DASHUND does not control and whose availability it does not guarantee: an outage or a change at Figma may interrupt all or part of the Service. This dependency does not release DASHUND from its own obligations.

14. Liability

Each party is liable for the direct damage it causes to the other through a breach of its obligations. DASHUND is not liable for indirect damage, such as loss of revenue, customers or business opportunity. DASHUND’s total liability, for all causes combined, is limited to the amounts paid by the customer for the Service during the 12 months preceding the event giving rise to liability.

These limitations do not apply in the event of gross negligence or willful misconduct, personal injury, or where the law prohibits limiting liability; they do not limit the rights that data subjects derive from the GDPR.

15. Changes to the Terms

DASHUND may change the Terms. Any significant change is announced at least 30 days before it takes effect, by email or in the Service. A customer who refuses it can cancel their subscription with no commitment before that date; a commitment in progress remains governed, as to its price and term, by the Terms in force when it was purchased.

16. Order of precedence

In the event of a conflict between the contractual documents: the data processing agreement prevails for everything relating to personal data processed on the customer’s behalf; the Terms prevail for everything else; the privacy policy is an informational document. Specific terms signed between DASHUND and a customer prevail over the Terms for the points they expressly govern. If this English version and the French version differ, the French version prevails.

17. Governing law and disputes

The Terms are governed by French law. In the event of a dispute, the parties first seek an amicable solution: the customer writes to contact@dashund.link, and the parties then have 30 days to reach an agreement. Failing that, the dispute is brought before the competent courts of Paris, France, where the law allows the parties to agree on this, and otherwise before the court designated by the ordinary rules of law.
